FuseWorks Pty Ltd 159 891 335 (FuseWorks, We, Our, Us, and other similar terms and including partner entity FuseWare Pty Ltd 605 751 246) takes all reasonable steps to implement processes and procedures for the responsible management of Personal Information and Data.

We have implemented this Privacy Policy in accordance with the Privacy Act 1988 (Cth)(Act), the Australian Privacy Principles (APP), the General Data Protection Regulation (GDPR) and other data protection rules in order to be open and transparent about how We collect, hold, and use Your Personal Information, and under what circumstances We may disclose or transfer it.

This Privacy Policy applies to all Personal Information collected by FuseWorks in the course of providing services to Our customers (You, Your, Data Subject and other similar terms) regardless of its source and forms part of the terms and conditions of our various agreements with You.

Definitions

In this Privacy Policy, unless the context or subject matter otherwise require:

Client means a person who has paid to use any one (1) or more of Our Products

Controller has the meaning given to it in Article 4 of the GDPR.

Data means any information which is reduced to electronic form and stored in any of our computer systems.

End User means a person authorised by the Client to access and use any one (1) or more of Our Products.

Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable:

  1. whether the information or opinion is true or not; and whether the information or opinion is recorded in a material form or not.

Processor has the meaning given to it in Article 4 of the GDPR.

Products mean:

  1. FuseDocs;
  2. FuseSign; and
  3. FuseCharts.

Sensitive Information means:

  1. information or an opinion about an individual's:
    1. racial or ethnic origin; or
    2. political opinions; or
    3. membership of a political association; or
    4. religious beliefs or affiliations; or
    5. philosophical beliefs; or
    6. membership of a professional or trade association; or
    7. membership of a trade union; or
    8. sexual orientation or practices; or
    9. criminal record;
  2. that is also personal information; or
  3. health information about an individual; or
  4. genetic information about an individual that is not otherwise health information; or
  5. biometric information that is to be used for the purpose of automated biometric verification or biometric identification; or
  6. biometric templates.

Collection

Collection of Personal Information

  1. We collect Personal Information:
    1. when You interact with us online, over the phone, by email, in person or through other means of communication; and
    2. to assist You with the supply of goods, the provision of services, and to provide any related assistance or for other purposes requested through such communication.
  2. The type of Personal Information We collect includes Your name, address, telephone number, email address, company details and any additional information You provide to Us.
  3. Where You contact Us on behalf of Your employer, the information You provide often contains information about Your employment, position and employer’s contact details. In those circumstances certain employment information is collected.
  4. Information will only be collected directly from You unless You authorise another person to provide the information.

Sensitive information

FuseWorks does not collect sensitive information or sensitive Personal Information as defined in section 6 of the Act or in Article 9 of the GDPR respectively.

Device information and cookies

  1. When You visit any of Our websites available at at https://www.fuse.work or https://fusesign.com or access Our online application available at https://app.fuse.work , We may collect certain information about Your visit, including Your IP address and details about Your Web browser, including the type of browser and the operating system on which it is running, Your primary language preference, and whether Your browser is currently storing cookies previously set by Our website. Additionally, as You browse, We collect information about the individual Web pages You view, what websites or search terms referred You, and information about how You interact with Us online.
  2. We collect device information using the following technologies:
    1. ‘Cookies’ which are data files placed on Your device or computer which may include an anonymous unique identifier;
    2. ‘Log files’ which track actions occurring on the website, and collect data including Your IP address, browser type, referring/exit pages, and date/time stamps; and
    3. ‘Web beacons’, ‘tags’, and ‘pixels’ which are electronic files used to record information about Your browsing session.
  3. Please note that We do not alter our websites’ data collection and use practices when Your browser is set to send a Do Not Track signal.
  4. You may refuse the use of cookies by selecting the appropriate settings on Your browser, however if You do, You may not be able to use the full functionality of Our website.
  5. We do not collect Personal Information or associate the information collected via cookies, web beacons, tags, log files or pixels with other Personal Information We collect.

Use

General use

  1. We use Personal Information collected as part of Our business operations which are primarily associated with the sale of goods and the provision of services in relation to technology services such as electronic signing and document automation. Examples of when Your information may be used include:
    1. informing You about Our goods and services;
    2. providing You with the goods and services requested;
    3. administration needs in relation to providing You with goods and services, including managing Your account;
    4. dealing with requests, enquiries or complaints and other customer care related activities; and
    5. carrying out any activity in connection with a legal, governmental, or regulatory requirement imposed on Us or in connection with legal proceedings, crime or fraud prevention, detection or prosecution.
  2. We may also use Personal Information for purposes, as would be reasonably expected by You, in connection with those activities described above. However, We will not use Your Personal Information for purposes, other than as described in this Privacy Notice or other agreement We have with You, unless You consent to that use or there are specific law enforcement, public health or safety reasons.

Direct marketing

Where You have elected to be included on our mailing list or to receive other electronic communications, We may use Your contact details to send You those communications. To opt-out of receiving marketing material, You may contact Us via the details below or select the ‘unsubscribe’ link provided in that communication.

Accessing Your information

Upon Your request and after satisfying ourselves of Your identity, We will provide access to the Personal Information We hold about You except in certain prescribed circumstances. These include, where:

  2. giving You access would be unlawful;

Sharing information

We may disclose Personal Information to:

  1. Our employees, a related entity and Our professional advisors, such as Our lawyers and accountants;
  2. emergency services providers to assist in the prevention of harm and risk to life;
  3. law enforcement agencies to assist in the investigation and prevention of criminal activities; and
  4. Our third-party contractors or service providers with whom We have a business association, including:
    1. marketing service providers;
    2. accounting service providers; and
    3. information technology service providers including cloud application providers.

Finally, We may also share Your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information We receive, or to otherwise protect Our rights.

Offshore transfers

The Personal Information We collect may be transferred out of Australia and to countries including the United States of America where it is processed by third party providers of cloud-based services, who assist Us to manage promotional material, email, office administration, and accounting services. FuseWorks relies solely on service providers with a track-record for reliability and carries out annual reviews to ensure they are complying with their obligations.

While We do not otherwise actively disclose Your Personal Information to other overseas entities, the service providers We engage may use international data centres and disaster recovery sites. Consequently, these providers may have access to Your information.

Regardless of where You reside Your right to Privacy is protected in Australia pursuant to the Privacy Act 1988 (Cth) which is administered by the Office of the Australian Information Commissioner (OAIC).

Anonymity and use of pseudonyms

We may interact with You anonymously or using pseudonyms if You have questions that are general in nature. However, You are required to provide true and accurate details when requesting the supply of goods or the provision of services. You agree to provide accurate information if so required.

Security

We take commercially reasonable steps to protect the Personal Information We hold from misuse, loss and unauthorised access, modification or disclosure. We do this by:

  1. maintaining and keeping our systems up to date;
  2. using secure servers protected from unauthorised access, modification, or disclosure;
  3. where possible using multi-factor authentication where it is available;
  4. using Secure Sockets Layer (SSL) encryption to transfer data across public networks, such as the internet;
  5. relying on reputable service providers; and
  6. limiting the collection of Your Personal Information to that which We reasonably require.

Data retention

  1. If We hold Personal Information about You, and We do not need that information for any purpose, We will take reasonable steps to destroy or de-identify that information, in accordance with the APPs and the European Union General Data Protection Regulation (GDPR), unless We are prevented from doing so by law.
  2. Under Australian law, financial records, such as those relating to financial transactions, must be retained for seven (7) years after the transactions associated with those records are completed.
  3. We envisage that Your Personal Information will be deleted or de-identified within ten (10) years if it is no longer reasonably required for the purposes for which it was collected.
  4. You may make a request to Us in writing to remove Your Personal Information and, where permitted, We will do so in accordance with the APPs and the GDPR.

Additional rights under the GDPR

  1. If You are an EU resident or citizen and use Our Products, You have the right to access the Personal Information We hold about You and to ask that Your Personal Information be corrected, updated, or deleted. You may also object to the processing of Your Personal Information.
  2. FuseWorks is a:
    1. Controller and Processor of Client Personal Information; and
    2. Processor of End User Personal Information.
  3. In accordance with Article 37 of the GDPR We are not required to appoint a data protection officer as Our processing operations do not require regular and systematic monitoring of Data Subjects on a large scale.
  4. If We hold Personal Information about You that was not provided directly from You, We will provide You with the relevant information regarding the source of the Personal Information in accordance with Article 14 of the GDPR.
  5. Pursuant to Article 21 of the GDPR You have the right at any time to object to processing of Personal Information concerning You:
    1. necessary for the performance of a task carried out in the public interest or in the exercise of officially authority vested in Us as a Controller, including profiling;
    2. necessary for the purposes of the legitimate interests pursued by Us as Controller or a third party, except where such interests are overridden by the interests of fundamental rights and freedoms of the Data Subject which require protection of Personal Information, including profiling; or
    3. for marketing purposes, including profiling to the extent that it is related to direct marketing,
  6. Should you object to Us processing Your Personal Information, We as Controller will no longer process the information unless we have legitimate grounds which override the interests, rights and freedoms of the Data Subject or for the establishment, exercise or defence of legal claims.
